Who we are and what this policy covers

Eagle Eye ELD, Inc. ("Eagle Eye ELD," "we," "us," or "our") operates an FMCSA-registered Electronic Logging Device platform serving commercial motor carriers in the United States and Canada. This Privacy Policy explains how we collect, process, store, and share personal information when you use our ELD hardware, mobile application, web dashboard, and related services (collectively, the "Platform").

This policy applies to all users of our Platform including fleet owners, fleet managers, truck drivers, and website visitors. By accessing or using our Platform, you agree to the practices described in this policy.

Quick Summary We collect only the data necessary to operate a compliant, reliable ELD platform. We do not sell your personal data to third parties. You have meaningful rights over your information, and we maintain strong security safeguards to protect it.

Data We Collect

What information we gather and why

We collect information in three ways: information you provide directly, information generated automatically by our ELD hardware and software, and information from third-party sources such as your motor carrier's TMS system.

FMCSA-Mandated Data HOS logs, vehicle data, and driver identification are required by FMCSA regulations (49 CFR § 395.22). This data cannot be excluded from collection — it is the legal basis of our ELD service.

How We Use Your Data

The purposes for which your information is processed

We use your data only for the purposes listed below. We do not use your data for advertising, sell it to data brokers, or profile you for non-fleet-related purposes.

  • ELD Service Delivery: Provide HOS logging, GPS tracking, DVIR processing, IFTA reporting, and all Platform features as described in your subscription plan.
  • FMCSA Compliance: Maintain records as required by 49 CFR Part 395 and facilitate roadside inspection data transfers to enforcement officers.
  • Safety & AI Analysis: Detect harsh driving events, generate safety scores, and provide driver coaching reports (Professional/Enterprise plans).
  • Account Management: Create and maintain your account, process payments, send service notifications, and handle support requests.
  • Platform Improvement: Analyze anonymized, aggregated usage patterns to improve features, fix bugs, and develop new capabilities.
  • Legal Compliance: Comply with applicable laws, respond to lawful government requests, and protect our legal rights.
  • Security: Detect fraud, prevent unauthorized access, and maintain the integrity of our Platform.
What We Never Do We never sell your personal data to advertisers, data brokers, or third parties for marketing. We never use HOS or GPS data for purposes unrelated to your fleet's operations or legal compliance.

Data Sharing & Disclosure

Who we share your information with and why

We share personal data only in the limited circumstances described below. We require all third parties to maintain equivalent protections under binding data processing agreements.

  • Fleet Administrator: Your employer (the motor carrier) has access to all HOS, GPS, DVIR, and safety data for vehicles and drivers under their account.
  • DOT / FMCSA Enforcement Officers: During roadside inspections, HOS data is transferred to enforcement per 49 CFR § 395.22(g). We do not proactively share data with government agencies.
  • Service Providers: Cloud hosting (AWS), payment processing (Stripe), email delivery (SendGrid), and analytics tools operate under strict data processing agreements and may not use your data independently.
  • Integration Partners: If you enable a TMS, payroll, or dispatch integration, data is shared with that system per your explicit authorization.
  • Legal Requirements: We may disclose data in response to a valid court order, subpoena, or government request, or to protect the safety of any person or the public.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your data may be transferred to the successor entity under equivalent privacy protections.
We Never Sell Your Data Eagle Eye ELD does not sell, rent, or trade personal information to third parties for monetary or other consideration. This applies to all data categories including HOS logs, GPS location, and driver identifiers.

Data Retention

How long we keep your information

We retain personal data only as long as necessary to deliver our services, meet legal obligations, and resolve disputes. FMCSA regulations mandate minimum retention periods for certain ELD records.

Upon account termination, we will delete or anonymize personal data within 90 days, except where longer retention is required by law. You may request early deletion of non-legally-mandated data per your rights in Section 7 below.

Data Security

How we protect your information

We implement industry-standard technical and organizational safeguards to protect your data against unauthorized access, disclosure, alteration, and destruction.

Encryption
AES-256 encryption at rest. TLS 1.3 for all data in transit between devices, app, and servers.
Access Controls
Role-based access, multi-factor authentication, and principle of least privilege enforced across all systems.
Monitoring
24/7 intrusion detection, anomaly alerting, and automated threat response powered by SOC team.
Penetration Testing
Annual third-party penetration tests and SOC 2 Type II compliance audits. Results reviewed by leadership.
Infrastructure
Hosted on AWS GovCloud-adjacent infrastructure in US-East and US-West regions with full redundancy.
Breach Response
Documented incident response plan. Affected users notified within 72 hours of confirmed breach per applicable law.
Report a Security Issue If you discover a security vulnerability, please email security@eagleeyeeld.com immediately. We operate a responsible disclosure program and will respond within 24 hours.

Your Privacy Rights

What you can request and how to exercise your rights

Depending on your jurisdiction, you have the following rights regarding your personal data. California residents have additional rights under CCPA; Canadian residents have rights under PIPEDA. Submit requests to privacy@eagleeyeeld.com.

Right to Access
Request a copy of all personal data we hold about you in a portable, machine-readable format.
Right to Correct
Request correction of inaccurate or incomplete personal information. Changes take effect within 30 days.
Right to Delete
Request deletion of non-legally-mandated data. FMCSA-required records cannot be deleted during mandatory retention.
Right to Object
Object to processing for analytics, marketing communications, or profiling purposes at any time.
Right to Restrict
Request restriction of processing while a correction or objection request is under review.
Data Portability
Receive your HOS logs, GPS history, and account data in JSON or CSV format on request.

We will respond to all valid rights requests within 30 days (or 45 days where permitted by law). We may need to verify your identity before processing requests. Requests can be submitted by email to privacy@eagleeyeeld.com or through your account dashboard under Settings → Privacy.

California Residents — CCPA Rights California residents may also request to know the categories of personal data disclosed for a business purpose in the past 12 months, opt out of the sale of personal information (we do not sell), and not be discriminated against for exercising privacy rights.

Children's Privacy

Our policy regarding users under 18

Eagle Eye ELD is a commercial fleet management platform intended exclusively for use by adults in professional trucking and transportation roles. Our Platform is not directed at children under the age of 18, and we do not knowingly collect personal information from anyone under 18.

If we become aware that we have inadvertently collected data from a person under 18, we will delete that information promptly. If you believe we have collected data from a minor, please contact us at privacy@eagleeyeeld.com.

International Data Transfers

How we handle cross-border data flows

Eagle Eye ELD is headquartered in the United States and primarily stores and processes data on US-based servers (AWS US-East-1 and US-West-2). Canadian fleet operators' data is subject to PIPEDA and may be processed in the US in accordance with our service agreement.

  • All US-Canada data transfers occur under contractual data protection clauses equivalent to PIPEDA requirements.
  • No ELD data is transferred to jurisdictions outside of the United States and Canada without explicit consent.
  • Sub-processors (AWS, Stripe, SendGrid) are bound by data processing agreements meeting applicable cross-border transfer requirements.

Changes to This Policy

How we notify you when this policy is updated

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or new Platform features. When we make material changes, we will:

  • Post the updated policy on this page with a new "Last Updated" date at the top.
  • Send an in-app notification and email to all fleet administrators at least 14 days before material changes take effect.
  • For significant changes affecting your rights, obtain renewed consent where legally required.

Your continued use of the Platform after the effective date of an updated policy constitutes your acceptance of the changes. Previous versions of this policy are available upon request.
